On August 4, 2026, the Immigration Services Agency of Japan officially released its draft revision of the Guidelines for Permanent Residence ("永住許可に関するガイドライン改定(案)") and opened a public comment period (パブリックコメント/意見公募手続). This follows several weeks of media reports in late July, and is now confirmed by the Agency's own published documents. This article summarizes the official content.
Background: The Three Statutory Requirements
Under Article 22, Paragraph 2 of the Immigration Control and Refugee Recognition Act, an applicant for permanent residence must meet three requirements: (1) good conduct, (2) sufficient assets or skills to make an independent living, and (3) that the applicant's permanent residence is recognized as being in the interest of Japan. The Guidelines set out the Agency's thinking on how these requirements are assessed in practice. The draft revision explicitly states, for the first time, that because permanent residence is "the most stable legal status, with no restriction on activity or period, under which the person is expected to spend the rest of their life in Japan," it requires particularly careful screening.
Key Points of the Draft Revision
(1) Good conduct requirement — unchanged
No substantive changes are proposed to this requirement.
(2) Independent living requirement — income and pension
The draft states that applicants must meet economic conditions equivalent to or better than those of Japanese nationals, both now and in the future.
- Income: The applicant's income must continuously reach a level exceeding the average income of Japanese households of the same household size (a raised standard). Reference will be made to the Ministry of Internal Affairs' Family Income and Expenditure Survey, the Ministry of Health, Labour and Welfare's Comprehensive Survey of Living Conditions, and the National Tax Agency's Statistical Survey of Actual Status for Salary.
- Pension (new requirement): The applicant's expected future pension benefit must reach the level that would be received after 30 years of Employees' Pension Insurance enrollment at the income level above. Where the expected amount falls short, sufficient financial assets to make up the difference may be taken into account.
(3) National interest requirement
The draft states that an applicant's permanent residence must actively and concretely bring benefit to Japan.
- Not becoming a public burden: Even for categories exempted from the independent living requirement (spouses or children of Japanese nationals, permanent residents, or special permanent residents; refugees; etc.), a realistic risk of becoming a public burden will be treated as a negative factor.
- Japanese language ability: Proficiency equivalent to CEFR B1 (an "independent user," per the JF Standard for Japanese-Language Education) will be required.
- Understanding of Japan's systems and rules: Insufficient understanding will be treated as a negative factor.
- Children's schooling: Failing to enroll a child of compulsory school age in school will be treated as a negative factor.
Other changes: spouses of Japanese nationals and permanent residents
The special exception that currently allows permanent residence with 3 years of marriage and 1 year of continuous residence in Japan (for spouses of Japanese nationals or permanent residents) will be extended to 5 years of marriage and 3 years of residence.
Implementation Timing
According to the official summary, the revised guideline is scheduled to apply generally from April 2027 (Reiwa 9), with the income-related element taking effect this October (2026).

2026年8月4日、出入国在留管理庁は「永住許可に関するガイドライン改定(案)」を正式に公表し、パブリックコメント(意見公募手続)を開始しました。7月下旬から各社で報じられていた内容が、入管庁自身が公表した資料により正式に確認された形です。本稿では、公表された内容を整理してご案内いたします。
背景:入管法上の永住許可の3要件
入管法第22条第2項では、永住許可の要件として、①素行が善良であること(素行善良要件)、②独立の生計を営むに足りる資産又は技能を有すること(独立生計要件)、③その者の永住が日本国の利益に合すると認められること(国益要件)の3つを定めています。ガイドラインは、審査に当たって考慮すべき要素についての基本的な考え方を示すものです。今回の改定案では、在留資格「永住者」について「活動・期間の制限が無く、生涯を本邦で過ごすことが想定される最も安定した法的地位」であることから、「特に慎重な審査を行う必要」があると初めて明記されました。
ガイドライン改定案の主なポイント
①素行善良要件について:特段変更なし
この要件については、実質的な変更は示されていません。
②独立生計要件について:収入・年金
現在及び将来において、日本人と同等水準以上の経済条件を求めることが明記されています。
- 収入:世帯人数に応じた日本人世帯の平均収入を上回る水準の額に継続して達しているかを求める(基準の引き上げ)。総務省の家計調査、厚生労働省の国民生活基礎調査、国税庁の民間給与実態統計調査を参考にするとされています。
- 年金(新規追加):将来の受給見込額が、上記の年収水準で30年間厚生年金に加入していた場合の水準に達しているかを求める。不足する場合は、補填可能な金融資産も考慮されます。
③国益要件について
積極的かつ具体的に、当該外国人の永住が日本国に利益をもたらす必要があることが明記されています。
- 公共の負担とならないこと:独立生計要件が不要とされる類型(日本人・永住者又は特別永住者の配偶者又は子、難民等)であっても、負担となるおそれが現実的であれば消極評価とされます。
- 日本語能力:CEFR(日本語教育参照枠)・B1相当(自立した言語使用者)が求められます。
- 我が国の制度等の理解:理解が乏しい者は消極評価とされます。
- 子の就学:学齢期(義務教育期間)に子を就学させていなければ消極評価とされます。
その他:日本人・永住者の配偶者等の特例
日本人・永住者の配偶者等について、婚姻期間3年かつ本邦在留期間1年で特例的に永住を認めていたところ、それぞれの期間を5年、3年に伸長するとされています。
適用時期について
公表された概要によれば、令和9年4月から適用される予定で、収入に関する要素については本年(2026年)10月から施行される見込みです。
